§1 General provisions

  1. These Regulations ("Regulations") are addressed to all Users of the NEIGE online store and define the rules for registration and use of the store account, the rules for making electronic reservations of products available in the store's offer, placing orders in the Store, and the rules for concluding sales agreements for goods.
  2. Every user can access the Regulations at any time by "clicking" the "Regulations" link located on the store's website, as well as by saving its PDF version to a chosen data storage device.
  3. The online store ("Store") is operated on the domain http://neigetees.com, and the subject of the Store's activity is the sale of clothing and related accessories.
  4. The entity operating the Store and the seller of the products placed on it is: NT Roman Buk

  5. Electronic correspondence regarding the Store's operations should be sent to the e-mail address store@neigetees.com, while traditional (postal) correspondence should be addressed to the address indicated in §1 point d) of the Regulations above.
  6. If the Customer is a natural person, they must be of legal age and have full legal capacity.
  7. Unless expressly stated otherwise in the commercial information, the goods available in the Store are brand new, and Roman Buk is responsible for any physical and legal defects thereof.
  8. Goods in the Store are thoroughly described. The website contains information about the properties of the goods, their price, the material they are made of, etc. The photos and presentations of the offered products are exemplary and serve to present the specific models indicated on them.

  2. Sklep internetowy („Sklep”) prowadzony jest na domenie http://neigetees.com, a przedmiotem działalności Sklepu jest sprzedaż odzieży oraz związanych z nią akcesoriami.

  4. Korespondencję elektroniczną dotyczącą działalności Sklepu należy wysyłać na adres  e-mail store@neigetees.com, natomiast korespondencję tradycyjną (pocztową) należy kierować na adres wskazany w §1 pkt. d) Regulaminu powyżej.
  5. Jeśli Klientem jest osoba fizyczna musi ona być pełnoletnia i posiadać pełną zdolność do czynności prawnych.
  6. Jeśli nie zostało to wyraźnie wskazane w informacji handlowej, towary dostępne w Sklepie są fabrycznie nowe, a podmiotem odpowiedzialnym za ich ewentualne wady fizyczne i prawne jest Roman Buk.
  7. Towary w Sklepie są szczegółowo oznaczone. Na stronie internetowej znajdują się informacje o właściwościach towaru, jego cenie, materiale, z którego jest wykonany itp. Zdjęcia i prezentacje oferowanych produktów są przykładowe i służą prezentacji konkretnie wskazanych na nich modeli.

§2 Placing orders

An essential element of the ordering procedure is the Client's review and acceptance of these Regulations, which the Client confirms by checking the appropriate box before placing an order. Failure by the Client to accept these Regulations during the ordering procedure makes it impossible to purchase goods through the Store.

  1. Client registration in the Store system is voluntary and free of charge. A Client who has registered in the Store system has access to additional options available through the Client Account.
  2. Registration involves creating a Client Account; in order to register a Client Account, the Client is required to read and accept these Regulations, as well as to consent to the processing of their personal data provided during registration.
  3. To place an order, it is necessary to complete the order through the Store (by "adding to cart"), fill out the order form with personal data and shipping data, and select the method of delivery of the goods; sending the order takes place after selecting the payment method from: bank transfer, PayPal, or credit card, and clicking the "Buy and pay" button.
  4. Orders can be placed 24 hours a day, every day of the year. Roman Buk reserves the right to temporarily suspend the Store's activity for maintenance reasons or the need to update data.
  5. Information about the total value of the order, which includes the price of the goods and the costs of their delivery, is always provided on the Store's website during the ordering process, including before direct approval and placement of the order by the Client; these are the total costs that the Client is obliged to pay, including applicable taxes and delivery costs.
  6. During the ordering procedure – until the moment of clicking the "Buy and pay" button, the Client has the option to modify the order, in particular regarding the selection of goods, the place of delivery of goods, the payment method, and the data provided in the order form; clicking the "Buy and pay" button results in the definitive placement of the order and the creation of an obligation on the part of the Client.
  7. After the Store system receives an order, an automatic message confirming receipt of the order will always be sent to the email address provided by the Client; the message is sent automatically and only confirms that the order has reached the Store.
  8. Then, the placed order is verified by the Store's automatic system; if the order can be fulfilled and is paid for, the Client receives an electronic message informing about the acceptance of the order for processing; at the moment the Client receives an electronic message confirming the acceptance of the order for processing, a sales contract is concluded between the Client and NT Roman Buk.
  9. Confirmation, making available, recording, and securing the content of the concluded contract takes place by sending the Client an electronic message confirming the acceptance of the order for processing, along with attachments in pdf format in the form of these Regulations, information on the right of withdrawal from the contract, and a template of the declaration of withdrawal from the contract.
  10. Roman Buk may refuse to accept or fulfill an order in whole or in part for valid reasons, and in particular if:- the goods indicated in the order are no longer available or delivery cannot be made within the period specified for the order,
    – order fulfillment is not possible due to incorrect operation of the Store's computer system,
    – the data provided by the Client is untrue,
    – the person placing the order is not of legal age or has not consented to the processing of their personal data by Roman Buk to the extent indicated in § 8 point a) of the Regulations, the order has not been paid for within 7 days from the date of its placement.
  11. Roman Buk will immediately inform the Client about the impossibility of fulfilling part or all of the order for the reasons specified in §2 point j) of the Regulations, to the e-mail address indicated in the order form or in the Client's account in the Store, if the Client placed the order using that account; in such a case, the Client may cancel the order in the part where fulfillment is not possible within the specified period or cancel the placed order in its entirety by informing Roman Buk via e-mail or in writing to Roman Buk's postal address indicated in §1 point d) of the Regulations.
  12. In the event of the Client's resignation from the order in the manner specified in §6 of the Regulations or the impossibility of fulfilling the order in its entirety for the reasons specified in §2 point j) of the Regulations, if the Client has already paid for the ordered goods in advance, Roman Buk will immediately refund the Client the paid price or its appropriate part, if the order is partially fulfilled. The refund will be made using the same payment method as used by the Client, unless the Client explicitly agrees to another refund method – in any case, the Client will not incur any fees in connection with this refund.
  13. Orders are handled by the Store's Client service department on working days, i.e., from Monday to Friday, excluding public holidays, from 9:00 AM to 4:00 PM.
  1. Rejestracja przez Klienta w systemie Sklepu jest dobrowolna i nieodpłatna. Klient, który dokonał rejestracji w systemie Sklepu ma dostęp do dodatkowych opcji dostępnych za pośrednictwem Konta Klienta.
  2. Rejestracja polega na utworzeniu Konta Klienta; w celu dokonania rejestracji Konta Klienta wymagane jest zapoznanie się i zaakceptowanie przez Klienta niniejszego Regulaminu, a także wyrażenie przez Klienta zgody na przetwarzanie jego danych osobowych podanych podczas rejestracji.
  3. W celu złożenia zamówienia należy za pośrednictwem Sklepu skompletować zamówienie (poprzez „dodaj do koszyka”), wypełnić formularz zamówienia danymi osobowymi i danymi do wysyłki, wybrać sposób dostarczenia towaru; przesłanie zamówienie następuje po wybraniu formy zapłaty spośród: przelewu bankowego, PayPal lub karty kredytowej oraz kliknięciu przycisku „Kupuję i płacę”.
  4. Zamówienia można składać przez całą dobę, każdego dnia w roku. Roman Buk zastrzega sobie prawo chwilowego wstrzymania działalności Sklepu ze względów konserwacyjnych lub konieczności uaktualnienia danych.
  5. Informacja o całkowitej wartości zamówienia, która obejmuje cenę towaru oraz koszty jego dostarczenia, jest każdorazowo podawana na stronie Sklepu w trakcie składania zamówienia, w tym przed bezpośrednim zatwierdzeniem i złożeniem przez Klienta zamówienia; są to całkowite koszty, które Klient zobowiązany jest zapłacić wraz z należnymi podatkami i kosztami dostarczenia towaru.
  6. W trakcie procedury składania zamówienia – aż do momentu naciśnięcia na przycisk „Kupuję i płacę”, Klient ma możliwość modyfikowania zamówienia w szczególności w zakresie wyboru towaru, miejsca dostarczenia towaru, sposobu płatności, danych podanych w formularzu zamówienia; naciśnięcie przycisku „Kupuję i płacę” powoduje definitywne złożenie zamówienia i powstaniu obowiązku po stronie Klienta.
  7. Po otrzymaniu przez system Sklepu zamówienia, każdorazowo wysyłana będzie na adres e-mail podany przez Klienta automatyczna wiadomość potwierdzającą otrzymanie zamówienia; wiadomość jest wysyłana automatycznie i potwierdza jedynie fakt dotarcia zamówienia do Sklepu.
  8. Następnie złożone zamówienie podlega weryfikacji przez automatyczny system Sklepu; jeśli zamówienie może zostać wykonane i jest opłacone Klient otrzymuje drogą elektroniczną wiadomość, informującą o przyjęciu zamówienia do realizacji; z chwilą otrzymania przez Klienta wiadomości elektronicznej z potwierdzeniem przyjęcia zamówienia do realizacji zostaje zawarta umowa sprzedaży pomiędzy Klientem a NT Romanem Buk.
  9. Potwierdzenie, udostępnienie, utrwalenie, zabezpieczenie treści zawartej umowy następuje przez przesłanie Klientowi wiadomości elektronicznej z potwierdzeniem przyjęcia zamówienia do realizacji wraz z załącznikami w formacie pdf w postaci niniejszego Regulaminu, pouczenia o prawie odstąpienia od umowy oraz wzoru formularza oświadczenia o odstąpieniu od umowy.
  10. Roman Buk może odmówić przyjęcia lub realizacji zamówienia w całości lub w części z ważnych przyczyn, a w szczególności jeśli:- towar wskazany w zamówieniu nie jest już dostępny lub dostawa nie może być zrealizowana w terminie określonym dla zamówienia,
    – realizacja zamówienia nie jest możliwa  z powodu niepoprawnej pracy systemu komputerowego Sklepu,
    – dane podane przez Klienta są nieprawdziwe,
    – osoba składająca zamówienia nie jest pełnoletnia lub nie wyraziła zgody na przetwarzanie przez Romana Buk swoich danych osobowych w zakresie wskazanym w § 8 pkt. a) Regulaminu, zamówienie nie zostało opłacone w terminie do 7 dni od dnia jego złożenia.
  11. Roman Buk niezwłocznie poinformuje o Klienta o braku możliwości realizacji części lub całości zamówienia z przyczyn określonych w §2 pkt. j) Regulaminu, na adres poczty elektronicznej (adres e-mail), wskazany w formularzu zamówienia lub w koncie Klienta w Sklepie, gdy Klient złożył zamówienie z wykorzystaniem tego konta; w takim przypadku Klient może anulować zamówienie w części, w której realizacja nie jest możliwa w wyznaczonym terminie lub anulować złożone zamówienie w całości informując o tym Romana Buk za pośrednictwem poczty elektronicznej albo w formie pisemnej na adres pocztowy Romana Buk wskazany w §1 pkt. d) Regulaminu.
  12. W przypadku rezygnacji przez Klienta z zamówienia w trybie określonym w §6 Regulaminu lub niemożliwości realizacji zamówienia w całości z powodów określonych w §2 pkt. j) Regulaminu, jeżeli Klient dokonał już zapłaty za zamówiony towar z góry, Roman Buk zwróci Klientowi niezwłocznie zapłaconą cenę lub jej odpowiednią część, w razie gdy zamówienie zostanie zrealizowane w części. Zwrot płatności nastąpi przy użyciu takiego samego sposobu zapłaty, jakiego użył Klient, chyba że Klient wyraźnie zgodzi się na inny sposób zwrotu płatności – w każdym przypadku Klient nie poniesie żadnych opłat w związku z tym zwrotem.
  13. Zamówienia są obsługiwane przez dział obsługi Klienta Sklepu w dni robocze tj. od poniedziałku do piątku z wyłączeniem dni ustawowo wolnych od pracy, w godzinach 9.00-16.00.

§3 Conclusion of the contract

  1. An order, the receipt of which has been confirmed by the Store's system (Article 2, point l of the Regulations), constitutes an offer in the meaning of Article 66 § 1 of the Civil Code and forms the basis for the conclusion of a sales contract between the Client and Roman Buk.
  2. The sales contract for the goods included in the order is concluded at the moment the Client receives information about the acceptance of the order for processing, made in accordance with Article 2, point l) of the Regulations.
  3. The Client accepts that the acceptance of the order for processing by Roman Buk entails the conclusion of a legally binding sales contract and the obligation to pay the price specified in the order, including shipping costs.
  4. Commercial information published in the Store does not constitute an offer in the meaning of Article 66 of the Civil Code, but is an invitation to make offers, even if this information includes a unit price of the goods.

§4 Payment

  1. For the performance of the sales contract, the Customer is obliged to pay the price of the goods specified in the order and the cost of their shipment. Payment of the price and shipping costs should be made within 7 days from the date of placing the order. Roman Buk will accept the order for processing after receiving the full amount specified in the order, unless the Customer has chosen "cash on delivery".
  2. The price of individual goods presented in the Store is the gross price expressed in Polish zlotys (PLN) – for customers using the website intended for the Polish market; in Euro (EUR) – for other customers. The price also includes the applicable value added tax at the current rate and does not include delivery costs.
  3. Payment is made in the form chosen by the Customer:
    – cash – cash on delivery – only for orders with delivery within the Republic of Poland;
    – bank transfer to the account number provided in the order confirmation email;
    – PayPal service;
    – PayU service – PayU S.A. ul. Grunwaldzka 186, 60-166 Poznań.
    – in the case of shipments with a delivery address outside the Republic of Poland weighing less than 1kg or more than 2kg, by concluding the purchase agreement, the Customer simultaneously grants Roman Buk power of attorney to conclude, on his behalf, an agreement for the delivery of the purchased goods via Polish Post and to pay for it.

The date of payment is the date the Roman Buk account held in the settlement agent's system is credited.

§5 Shipping and collection of goods

  1. Delivery takes place within 6 working days from the date of concluding the contract in accordance with §3 point b of the Regulations. During special promotional campaigns, the order shipping time may be extended to 14 working days from the date of concluding the contract in accordance with §3 point b) of the Regulations. Fulfilled orders receive "shipped" status.
  2. In the case of shipments with a delivery address outside the Republic of Poland weighing less than 1kg or more than 2kg, the Customer, by concluding the purchase contract, simultaneously grants Roman Buk power of attorney to conclude a contract on their behalf for the delivery of the purchased goods via Poczta Polska and to pay for it.
  3. Roman Buk entrusts the delivery of goods to third parties conducting business in this regard.
  4. Roman Buk may withhold shipment of ordered goods until full payment of the price along with shipping costs is received, unless the Customer chooses "cash on delivery".
  5. Products are delivered to the specified address in the Republic of Poland by the shipping company Sendit S.A., ul. Wagonowa 2b, 53-609 Wrocław. The delivery address provided by the Customer is considered the place of performance.
  6. The cost of shipping within the Republic of Poland varies depending on the provider, form, and weight of the shipment. Each time, the Customer is informed about the amount of the fee for the selected shipment before finalizing the order. For orders with a delivery address outside the Republic of Poland, it is individually agreed upon each time before the customer places the order. At the time of placing the order, the customer is informed about the full shipping costs.

§6 Right to withdraw from the contract

  1. In accordance with Article 27 of the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827), a Customer who is a consumer within the meaning of this Act, i.e., a natural person performing a legal act with an entrepreneur not directly related to their business or professional activity, who has concluded a distance contract through the Store, may withdraw from this contract within 14 days without giving any reason. The instruction on the right of withdrawal, containing in particular information on the method and deadline for exercising the right of withdrawal and on the costs of returning the goods in the event of withdrawal from the contract, which are borne by the Consumer, constitutes Appendix No. 1 to these Regulations.
  2. When exercising the right of withdrawal from a sales contract, the Customer may use the withdrawal form provided on the Store's website, a template of which constitutes Appendix No. 2 to these Regulations, but this is not mandatory. The completed and signed withdrawal form and the goods should be sent to the address indicated in §1 point d of the Regulations.
  3. The period for withdrawal from the contract begins on the day on which the consumer took possession of the goods or on which a third party indicated by the consumer, other than the carrier, took possession of the goods. To meet the deadline for withdrawal, it is sufficient to send information concerning the exercise of the right of withdrawal before the expiry of the withdrawal period. Detailed information regarding the exercise of the right of withdrawal is contained in Appendix No. 1 to the Regulations.
  4. In the event of withdrawal from the contract, the consumer is obliged to return the goods immediately, but no later than 14 days from the day on which they informed Roman Buk about the withdrawal from the contract. To meet the deadline, it is sufficient if the Consumer sends the goods before the expiry of the 14-day period to the address indicated in §1 point d of the Regulations.
  5. The cost of returning (shipping back) the purchased product is borne by the Customer.
  6. In the event of withdrawal from the contract, Roman Buk shall reimburse the Customer for all payments received from them, including the costs of delivering the goods, no later than 14 days from the day of receiving the Customer's statement of withdrawal from the contract, with the exception of additional costs resulting from the Consumer's choice of a delivery method other than the cheapest ordinary delivery method offered by Roman Buk.
  7. The refund is made depending on the payment method chosen by the Customer: to the bank account indicated by them or via PayU or PayPal. Roman Buk may withhold the refund of the amount received from the Customer until the goods are received or confirmation of their dispatch is provided, whichever occurs first.
  8. The right to withdraw from the contract is available only to Customers who are Consumers within the meaning of the act referred to in point a of the Regulations above.
  9. The Consumer is liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.

§7 Complaints

  1. Roman Buk is obliged to deliver goods to Customers without physical and legal defects. If the sold goods have physical defects or are otherwise not in conformity with the contract, the Customer has the right to free repair or replacement with new goods.
  2. Complaints regarding defects in goods should be submitted in writing to the address indicated in §1 point d of the Regulations.
  3. A complaint should contain at least:
    – name, surname,
    – correspondence address,
    – buyer's email address,
    – the date of concluding the contract forming the basis of the complaint, along with proof of its conclusion,
    – the subject of the complaint, indicating the buyer's request,
    – all circumstances justifying the complaint.
  4. If the data or information provided in the complaint requires supplementation, before processing the complaint, Roman Buk will ask the complainant to supplement it to the specified extent.
  5. Roman Buk will process the complaint no later than 14 days from the date of its receipt in the correct form.
  6. The cost of shipping the goods is borne by the Customer. If the complaint is deemed justified, Roman Buk will reimburse the Customer for shipping costs, not exceeding the cost of normal registered mail.
  7. Further rights related to defective goods are regulated by the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827).
  8. Complaints and comments regarding the functioning of the Store should be sent to the e-mail address store@neigetees.com

§8 Personal Data

  1. In the Account registration form, the Customer decides whether to consent to the processing and use of their personal data for the purpose of:– concluding and performing sales contracts as described in the Regulations,
    – marketing activities conducted by Roman Buk to promote his goods.
  2. Consent to the processing of personal data for the purpose indicated in §8 item a of the Regulations above is a condition for placing an order.
  3. The administrator of personal data is Roman Buk. Personal data disclosed by Customers are processed in the Roman Buk Customer Personal Data Collection registered with the General Inspector for Personal Data Protection.
  4. The Customer has the right to change their personal data or withdraw consent to their processing.

§9 Personal Data Protection

  1. The Customer's personal data is processed by the Seller as the personal data administrator. 
  2. Providing personal data by the Customer is voluntary but necessary for creating an Account and concluding a Sales Agreement.
  3. The Seller applies appropriate technical and organizational measures to ensure the protection of processed personal data.
  4. The Customer's Personal Data provided within the Online Store will be processed by the Seller for specific, defined purposes indicated in individual forms within the Online Store and described in detail in the Privacy Policy available in the Online Store.
  5. The Customer generally has the right, depending on the use of specific functionalities, to lodge a complaint with the competent personal data protection authority, the right to object, the right to access their personal data, request their rectification, erasure, restriction of processing, and data portability. 
  6. Additional explanations regarding personal data protection are contained in the "Privacy Policy" tab available in the Online Store.

§10 Cookies Policy

  1. To improve the convenience of its Users, the Website automatically collects information about its Users, as well as information contained in cookies.
  2. Cookies are IT data, in particular text files, which are stored on the Website User's end device and are intended for using the Website's web pages. Cookies usually contain the name of the website from which they originate, their storage time on the end device, and a unique number.
  3. The entity placing cookies on the Website User's end device and accessing them is NT Roman Buk Ligonia 43a 47 – 325 Kamień Śląski.
  4. The Website uses two main types of cookies: "session" cookies and "persistent" cookies. "Session" cookies are temporary files that are stored on the User's end device until logging out, leaving the website, or turning off the software (web browser). "Persistent" cookies are stored on the User's end device for the time specified in the cookie parameters or until they are deleted by the User.
  5. In many cases, software used for browsing websites (web browser) by default allows the storage of cookies on the User's end device. Website Users can change cookie settings at any time. These settings can be changed in particular to block the automatic handling of cookies in the web browser settings or to inform about their placement on the Website User's device each time. Detailed information on the possibilities and methods of handling cookies is available in the software settings (web browser).
  6. Cookies placed on the Website User's end device may also be used by advertisers and partners cooperating with the Website operator.

§11 Amendments to the Regulations

  1. NT Roman Buk informs about changes to the Regulations on the Store's website.
  2. Orders placed before the date of the change to the Regulations are fulfilled under the conditions applicable at the time of their placement.
  3. A Customer who does not accept the changes introduced in the Regulations has the right to delete their account at any time.

§12 References to other provisions

  1. In matters not covered by these regulations, the provisions of the Polish Civil Code and other laws shall apply. If the parties express such a will, disputes will be resolved amicably or through mediation proceedings. If an amicable settlement of the dispute is not possible, disputes shall be resolved by the competent courts.
  2. The provisions of these Regulations are not intended to limit or exclude any rights of Clients resulting from legal provisions, and in particular those provided for in the Act of April 23, 1964, Civil Code (consolidated text Journal of Laws of 2014, item 121, as amended) and the Act of April 30, 2014, on consumer rights (Journal of Laws of 2014, item 827).
  3. These Regulations enter into force on July 30, 2020, and apply to contracts concluded from that date.
